Judge Pedraz has rejected García-Castellón's request to participate in the 'Leire case' due to ongoing investigation. The judge has rejected 'for the moment' in the Leire case the request of the former colleague in the Audiencia Nacional, the retired magistrate Manuel García-Castellón, who had asked to participate in the cause to be able to exercise particular accusation. In a provision, to which EFE has had access, Pedraz argues that the facts on which García-Castellón based his request for his participation are the subject of investigation in the cause in which the investigating judge of the court of instance number 9 of Madrid Arturo Zamarriego investigates the former PSOE militant Leire Díez for alleged maneuvers against judges, prosecutors and Guardia Civil commanders. Pedraz has asked Zamarriego to be inhibited from that investigation in his favor, considering that the new crimes that he investigates the presumed plot led by Leire Díez, specifically the crime against high institutions of the State, are the competence of the Audiencia Nacional, although he indicates to García-Castellón that those diligences of the judge of Madrid 'have not yet been accumulated to the present cause', so he cannot access his request now. In the writing in which he claims his participation, García-Castellón argues that in Pedraz's auto 'it is stated' that to that trama 'joined, by personal interests, Javier Pérez Dolset, investigated in different causes in the Audiencia Nacional' related to the Villarejo case that he instructed until his retirement. With that purpose, García-Castellón recalls, Pedraz's auto states that Pérez Dolset agreed with other investigated in that cause like the former Secretary of State Francisco Martínez, who is now being judged by the Kitchen case, the piece number 7 of the Villarejo case, to seek 'reserved, secret or compromising information' about the then instructor. Also mentions that the businessman Luis del Rivero, former president of the Sacyr group, declared before the judge Zamarriego as a witness that in a meeting with Leire Díez and Pérez Dolset 'it was proposed the eventual existence of economic offers' to García-Castellón in addition to trying to discredit his work. For the retired magistrate, this meeting, held on May 7, 2025, constitutes 'a paradigmatic example of the described dynamics' in Pedraz's auto, 'the incorporation of a judge as an object of analysis, of obtaining information and, in his case, of eventual pressure or instrumentalization in the framework of a broader strategy aimed at influencing the development of judicial procedures'. He also recalls that in the cause instructed by Zamarriego his participation was initially accepted, although it was left without effect when Leire Díez appealed, a decision that García-Castellón appealed in turn and is pending resolution.
